Scandal in the Courtroom: Found Guilty Without Trial is about the life of a dairy farmer and his son in Copake, New York. The closely–knit community in the beautiful Taconic countryside is undone by a serial arsonist who burns building after building. Who is terrorizing these once trusting and peaceful citizens?
Today many innocent people are in jail or are ruined because of judicial and lawyer misconduct. Scandal in the Courtroom: Found Guilty without Trial follows a case in which a federal district judge failed to investigate and act on a complaint of lawyer misconduct. It calls for changing the procedures set up in the Judicial Conduct and Disability Act of 1980.
As written, when a complaint of judicial misconduct is filed it goes to the Chief Judge of the Court of Appeals. He is allowed to dispose of it with a limited investigation. His likely investigation is to send a copy of the complaint to the judge for a response. If the decision is appealed it goes to the full Judicial Council for review. An investigation is not required.
The first step in correcting a problem is to get everyone to agree what I the problem is. Today our courts do not work. This book calls for changing the procedures set up in the Judicial Misconduct and Disability Act of 1980 to require an investigation by the Department of Justice. Judges investigating judges is not working.
